Terms & Conditions for Creators & Influencers

1. Scope

These additional terms apply to all content creators and influencers ("Creators") using the Cre8ify platform. They supplement the General Terms and Conditions. In case of conflict, these Creator Terms prevail.

2. Independent Contractor Relationship

As a Creator, you act as an independent contractor — not as an employee of Cre8ify or any Brand. You are solely responsible for adhering to local tax regulations and fulfilling any legal obligations associated with your earnings. This includes, but is not limited to, income tax, social security contributions, VAT/sales tax registration (where applicable), and any withholding tax obligations that may arise from receiving payments from a UAE-based entity.

Cre8ify does not withhold taxes on your behalf and recommends consulting a tax professional in your jurisdiction.

3. Content Delivery Requirements

Deliver content strictly according to the briefing within five (5) full business days after receiving the product (if applicable). Brands have five (5) business days to review and may request one (1) revision. If no revision is requested within the review period, the order is automatically finalized and payment is released.

4. Quality Standards

All content must meet the following minimum quality standards:

Video — Full HD (1080p) or higher resolution, stable footage, proper lighting and clear audio.

Photos — minimum 2 megapixels, proper exposure and composition.

All content must fully comply with the assigned briefing. Offensive, harmful, illegal, or unlicensed material (including copyrighted music, trademarks, or third-party content used without permission) is strictly prohibited.

5. Content During Disputes

In the event of a dispute between a Creator and a Brand regarding delivered content, neither party may use, publish, or distribute the disputed content until the dispute is resolved through Cre8ify's mediation process or other dispute resolution mechanisms. The Creator retains ownership of the content but may not license it to third parties while the dispute is pending.

6. Intellectual Property and Rights Assignment

Upon full payment, you grant Cre8ify and the Brand a non-exclusive, worldwide, royalty-free license to use the content — two (2) years for paid advertising and five (5) years for organic use. Any rights not explicitly transferred remain with you. You retain the right to use the content in your personal portfolio.

7. Warranties and Indemnification

You warrant that you hold all necessary rights to your content, that it does not infringe any third-party rights (including intellectual property, privacy, and publicity rights), and that all persons appearing in the content have given their consent. You agree to indemnify Cre8ify and its Brands against any claims arising from your content.

8. Confidentiality

All briefing materials, brand strategies, product information, and other non-public information shared with you through the platform shall be treated as confidential. You may not disclose, share, or use such information for any purpose other than fulfilling orders placed through Cre8ify. This obligation survives termination of your account for a period of two (2) years.

9. Payments and Payouts

Payments are processed via Stripe or another authorized payment processor after the Brand accepts the content or the revision period expires. Payouts are subject to admin approval and require valid banking information (IBAN, BIC, account holder name). You are solely responsible for your own tax obligations. Payout processing may take up to seven (7) business days after approval. There is no minimum payout threshold — all approved earnings will be processed in the next payout cycle.

10. Platform Exclusivity

You agree not to work directly with Brands discovered via Cre8ify outside of the platform. Violations may result in permanent suspension and legal action.

11. Event Attendance (Golden Circle)

Attendance at confirmed Golden Circle events is binding. You must check in at the event and upload proof of attendance (Instagram story and Google review) within twenty-four (24) hours. The following strike system applies:

First strike — warning notification.

Second strike — temporary suspension from Golden Circle events for 30 days.

Third strike — permanent ban from the Golden Circle program.

Strikes are issued for no-shows after confirmation, failure to upload proof of attendance, or misconduct at events.

12. Content Moderation

Cre8ify reserves the right to review, flag, remove, or restrict any content uploaded by Creators that violates these Terms, the General Terms, applicable laws, or Cre8ify's content guidelines. Creators will be notified of content removal and may appeal the decision by contacting legal@cre8ify.com within fourteen (14) days.

13. Account Termination and Suspension

Cre8ify may suspend or terminate your account for Terms violations, repeated failure to deliver, consistently low quality submissions, or misconduct. You may request deletion of your account at any time.

14. Liability

You are solely responsible for the content you create and deliver. Cre8ify disclaims liability for Creator content except in cases of gross negligence or willful misconduct by Cre8ify. The limitations of liability set out in the General Terms apply.
