Cancellation & Refund Policy

Cre8ify — Right of Withdrawal, Cancellation and Refund Policy

1. General

Cre8ify is operated by UPHORIA FZCO, a company registered in Dubai, United Arab Emirates. Our services are governed by the laws of the UAE.

By using our platform and purchasing any services, you acknowledge and agree that all purchases are subject to this Cancellation & Refund Policy.

2. Digital Services — No Refunds

Cre8ify provides digital services that begin immediately upon purchase or upon assignment of a Creator. Due to the nature of digital services, all purchases are final and non-refundable once the service has commenced. This includes but is not limited to:

UGC Orders: Once a Creator has been assigned and accepted your order, no refund is possible.

Golden Circle Subscriptions: Subscription fees are non-refundable for the current billing period.

Golden Circle Events: Once influencers have been confirmed for an event, no refund is available.

Platform Fees: Any platform fees, service fees, or processing fees charged by Cre8ify are non-refundable.

Add-On Services: Any additional services purchased (e.g., rush delivery, extended licenses) are non-refundable once activated.

3. Waiver of Right of Withdrawal for EU/EEA Users

For users residing in the European Union or European Economic Area: In accordance with Article 16(m) of Directive 2011/83/EU, the statutory 14-day right of withdrawal does not apply to contracts for the supply of digital content which is not supplied on a tangible medium if the performance has begun with your prior express consent and your acknowledgment that you thereby lose your right of withdrawal.

By placing an order or activating a subscription on Cre8ify, you expressly consent to the immediate commencement of the digital service and acknowledge that you lose your right of withdrawal once the service has begun (i.e., once a Creator has been assigned, a subscription has been activated, or an event has been confirmed). This consent is obtained via a mandatory checkbox during the purchase process.

If the digital service has not yet commenced (i.e., no Creator has been assigned and no subscription has been activated), you may exercise your right of withdrawal within 14 days of purchase by contacting legal@cre8ify.com. In such cases, a full refund will be issued to the original payment method.

4. Golden Circle Subscription Cancellation

You may cancel your Golden Circle subscription at any time. Upon cancellation:

Your subscription remains active until the end of the current billing period.

No further charges will be made after cancellation.

No partial or pro-rata refund will be issued for the remaining days of the current billing period.

Any unused event credits, benefits, or features associated with the subscription will expire at the end of the billing period and cannot be carried over, transferred, or redeemed for cash.

Subscriptions automatically renew at the beginning of each billing cycle unless cancelled before the renewal date. It is your responsibility to cancel before the renewal date if you do not wish to be charged for the next period. Charges processed after auto-renewal are non-refundable.

To cancel your subscription, go to Account > Subscriptions > Manage Subscription in the app or web platform.

5. UGC Order Cancellation

The following cancellation rules apply to UGC orders:

Before Creator assignment: Orders may be cancelled before a Creator has been assigned. A cancellation fee of 10% of the order value (minimum USD 5.00 or equivalent) may apply to cover administrative and processing costs. Contact support for assistance.

After Creator assignment: Once a Creator has accepted and begun working on your order, cancellation is not possible and no refund will be issued. The order is considered commenced at the moment a Creator accepts the assignment.

Non-delivery by Creator: If a Creator fails to deliver within the agreed timeframe, Cre8ify will, at its sole discretion, either reassign the order to a new Creator or issue a credit to the Brand's Cre8ify account. Cash refunds for non-delivery are issued only if no suitable replacement Creator is available and only at Cre8ify's discretion.

6. Affiliate Commissions

Affiliate commissions are subject to verification before payout as described in the Affiliate Terms and Conditions. Commissions that have been incorrectly credited, earned through prohibited methods, or resulting from technical errors are not refundable and may be corrected or reversed at any time. Cre8ify reserves the right to offset any overpaid commissions against future payouts or to reclaim overpaid amounts directly.

7. Chargebacks

If a user initiates a chargeback or payment dispute through their bank or payment provider:

Cre8ify reserves the right to immediately suspend the user's account pending investigation.

If the chargeback is determined to be unjustified (i.e., the service was delivered as described), Cre8ify may charge the user an administrative fee of up to USD 50.00 (or equivalent) to cover the costs of the chargeback process, in addition to the original transaction amount.

Repeated or fraudulent chargebacks will result in permanent account termination and may be referred to collection agencies or result in legal action.

Cre8ify reserves the right to report fraudulent chargeback activity to relevant fraud prevention databases.

Users are encouraged to contact Cre8ify at legal@cre8ify.com before initiating a chargeback so that we can attempt to resolve the issue directly.

8. Exceptions

Refunds may be considered in the following exceptional circumstances, at Cre8ify's sole discretion:

Technical errors resulting in verified duplicate charges.

Services not rendered solely due to platform malfunction caused by Cre8ify.

Fraudulent transactions (subject to investigation and verification by Cre8ify).

Cre8ify's determination of whether an exception applies is final and binding. To request a review, contact us at legal@cre8ify.com within seven (7) days of the transaction. Requests submitted after this period will not be considered.

9. Credits vs. Refunds

Where Cre8ify, at its sole discretion, determines that compensation is warranted, Cre8ify may issue platform credits to the user's Cre8ify account instead of a cash refund. Platform credits are non-transferable, non-refundable, have no cash value, and expire twelve (12) months after issuance. Cre8ify reserves the right to determine whether compensation is provided as a credit or a refund.

10. Payment Processing

All payments are processed through Stripe. In the rare event that a refund is approved, it will be credited to the original payment method within 5–10 business days, depending on your bank's processing time. Cre8ify is not responsible for delays caused by payment processors or banks.

11. Modifications

Cre8ify reserves the right to modify this Cancellation & Refund Policy at any time. Changes will be communicated via email or in-app notification at least 14 days before taking effect. Continued use of the platform after the effective date constitutes acceptance.
