Cre8ify — DMCA and Copyright Takedown Policy

1. Overview

UPHORIA FZCO ("Cre8ify", "we", "us") respects the intellectual property rights of others and expects all users of the Cre8ify platform to do the same. This policy outlines the procedures for reporting alleged copyright infringement in accordance with the United States Digital Millennium Copyright Act (DMCA), applicable UAE intellectual property laws, and other relevant international copyright frameworks.

Cre8ify acts as a marketplace facilitator and hosts content uploaded by users. We are not responsible for user-uploaded content but will respond promptly to valid takedown notices.

2. Reporting Copyright Infringement (Takedown Notice)

If you believe that content hosted on the Cre8ify platform infringes your copyright, you may submit a written takedown notice to our designated agent. Your notice must include all of the following:

(a) Identification of the copyrighted work you believe has been infringed. If multiple works are involved, provide a representative list.

(b) Identification of the material on the Cre8ify platform that you believe is infringing, with sufficient detail to allow us to locate the material (e.g., URL, username, order ID, or screenshot).

(d) A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.

(e) A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.

(f) Your physical or electronic signature.

3. Processing of Takedown Notices

Upon receipt of a valid and complete takedown notice, Cre8ify will:

(a) Review the notice for completeness and validity.

(b) Promptly remove or disable access to the allegedly infringing material at Cre8ify's sole discretion.

(c) Notify the user who uploaded the content ("alleged infringer") that the material has been removed and provide them with a copy of the takedown notice (with the complainant's personal contact details redacted at Cre8ify's discretion).

(d) Retain records of the notice and actions taken.

Cre8ify reserves the right to remove any content at any time, with or without a formal takedown notice, if Cre8ify reasonably believes the content infringes third-party intellectual property rights.

4. Counter-Notification

If you believe that your content was removed in error or that you have authorization to use the material, you may submit a counter-notification to legal@cre8ify.com. Your counter-notification must include:

(a) Identification of the material that was removed and the location where it appeared before removal.

(b) A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

(d) A statement that you consent to the jurisdiction of the courts of Dubai, UAE, and that you will accept service of process from the person who filed the original takedown notice.

(e) Your physical or electronic signature.

Upon receipt of a valid counter-notification, Cre8ify may, at its sole discretion, restore the removed content within 10–14 business days unless the original complainant notifies us that they have filed a court action to restrain the alleged infringer.

Cre8ify is under no obligation to restore content and reserves the right to keep content removed if it determines, in its sole judgment, that the content is infringing or otherwise violates our Terms and Conditions.

5. Repeat Infringer Policy

Cre8ify maintains a strict repeat infringer policy:

First offense: Content removal and written warning.

Second offense: Content removal, written warning, and temporary account suspension (up to 30 days).

Third offense: Permanent account termination and forfeiture of any pending payouts or commissions.

Cre8ify reserves the right to terminate any user's account at any time if, in Cre8ify's sole judgment, the user is a repeat infringer, regardless of whether the user has received prior warnings. The determination of what constitutes a "repeat infringer" is at Cre8ify's sole discretion.

6. Misrepresentation

Under the DMCA (17 U.S.C. § 512(f)), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be subject to liability for damages. Please ensure that your takedown notice or counter-notification is accurate before submission. Cre8ify reserves the right to seek damages from any party that submits a fraudulent or bad-faith notice.

7. Content Uploaded to Cre8ify

By uploading content to Cre8ify, you represent and warrant that:

(a) You are the original creator of the content or have obtained all necessary rights, licenses, and permissions.

(b) The content does not infringe any third-party intellectual property rights, including copyrights, trademarks, trade secrets, or rights of publicity.

(c) Any music, images, fonts, or other third-party elements used in your content are properly licensed for commercial use.

(d) All persons appearing in the content have provided their informed consent.

Cre8ify is not obligated to verify the intellectual property rights of content uploaded by users. Users bear full responsibility for ensuring their content does not infringe third-party rights.

8. Cre8ify's Intellectual Property

All platform materials, trademarks, logos, designs, software, algorithms, and branding are the exclusive property of UPHORIA FZCO. Unauthorized reproduction, distribution, modification, reverse engineering, or use of any Cre8ify intellectual property is strictly prohibited and may result in legal action.

9. Limitation of Liability

Cre8ify acts as a neutral intermediary and is not liable for content uploaded by users. Cre8ify makes no warranties regarding the non-infringement of user-uploaded content. To the maximum extent permitted by law, Cre8ify disclaims all liability arising from or related to copyright infringement by users of the platform.

Cre8ify's total liability under this policy shall not exceed the fees paid by the affected user to Cre8ify in the twelve (12) months preceding the claim.
